Who has to file the DC FP-31?

Anyone holding personal property in the District for business use — and renting out a DC property is a business, so licensed landlords are on the list. Registering your BBL opens a personal property tax account with the Office of Tax and Revenue, and from then on OTR expects an FP-31 return every year, filed electronically at MyTax.DC.gov by July 31.

Will I actually owe personal property tax on a small rental?

Usually not a dollar. The first $225,000 of personal property is exempt, and the appliances and furnishings of a one-to-three-unit rental come nowhere near that. The catch is that OTR expects the return anyway — a $0 return you never filed still becomes a delinquency notice.

I received a Notice of Delinquency for the FP-31. What now?

Don't panic — this is the most fixable scary letter DC sends. Penalties are a percentage of the tax you owe, so if your return is $0, filing it late usually clears the notice with nothing owed. The fix is to file the missing year on MyTax.DC.gov and answer the notice quoting its case number.
